United States - Pandemic May Excuse Performance Under Convention Governing International Sale of Goods


The COVID-19 pandemic has had a world-wide impact on global commerce and will unfortunately likely continue to do so for some time. Parties to commercial agreements have, in recent months, began to pay close attention to common law doctrines such as impossibility of performance, commercial impracticability and frustration of purpose that in certain situations may excuse performance or limit liability for non-performance of contracts impacted by the pandemic.
